Zoning Board of Appeals Minutes 6/14/05
FINAL

Present for the Board of Appeals and attending the meeting were:  Bill Rossi, Chair, Frank LoRusso, Chris Murphy, Rodney Bunker; Alternates Michael Halbreich, Wendy Weldon and Chuck Hodgkinson.  Absent were Barbara Armstrong and Peter Knight.  Also present:  Peter Rodegast for Jeanette & Rene Demeestere, Jeannie Fischer, Andrew Fischer, Ann Wallace, Katy Upson and Margaret Orlando.

Mr. Rossi opened the meeting at 7:00 PM with the following agenda:

-       Jeannie Fischer; 27 Cross Rip Lane; Map 24 Lot 20.
-       Peter Rodegast of South Mountain Co. for Jeannette & Rene Demeestere; 2 Daisy Lane; Map 12 Lot 44.1.

NEW CASES

JEANNIE FISCHER:  ZBA member Rodney Bunker recused himself from this case due to a conflict of interest.  Alternates Wendy Weldon and Michael Halbreich were appointed as voting members.
Jeannie Fischer summarized her plan to create a youth lot for her son Andrew and referred to the Planning Board’s Form A letter of approval with the condition that no guesthouse will be built on the 3.05 acre Lot # 1 as shown on the site plan dated 4/7/05.  

Bill Rossi asked for comments from the audience.  Katie Upson gave her full support to the plan and vouched for Ms. Fischer’s respect and concern for the neighborhood.  Mr. Rossi read a file letter from abutter Barbara Kimber who had no problem with the request for a youth lot while pointing out that this parcel does not pay yearly dues to the Association. The letter also expressed concern with the by-law that allows the youth lot recipient to sell it after ten years.  Ms. Fischer responded by stating she does pay dues to the association for road maintenance and snow plowing while adding the only dues she does not pay is for the tennis courts because no one in her family plays tennis.  Mr. Rossi read a file memo recording a phone conversation with abutter Don Davis that asked about the ability to expand the house that is on the youth lot.  Mr. Rossi pointed out that this house could be expanded just as any other house – within the constraints of Chilmark’s Zoning By-laws.  The Planning Board’s Form A letter of approval was also read aloud and Mr. Rossi summarized that Andrew Fisher’s youth lot application indicates he qualifies for a youth lot.

Mr. LoRusso made a motion to approve the application as presented and dated 4/7/05 with the Planning Board’s condition that no guesthouse is built on the 3.05-acre lot # 1.  Mr. Murphy seconded.  The vote was unanimous in favor.

PETER RODEGAST FOR JEANETTE & RENE DEMEESTERE:  Peter Rodegast summarized the plan for placing a 12’ X 8’ shed 36 feet from the lot line.  As required, he pointed out the letter of approval from the nearest abutter – within 100 feet – Jerome Kenney.  After a brief discussion, Chris Murphy made a motion to approve the plan as presented and dated May 12, 2005.  Mr. LoRusso seconded.  The vote was unanimous in favor.

OTHER BUSINESS

The May 10, 2005 ZBA Minutes were reviewed.  Mr. Murphy made a motion to approve the minutes as presented.  Mr. Bunker seconded.  The vote was unanimous in favor.
Mr. Halbreich made a motion to adjourn the meeting.  Mr. LoRusso seconded.  The vote was unanimous and the meeting was adjourned at 7:35 PM.
